TERMS AND CONDITIONS

 

(By purchasing this unit the purchaser agrees to the following.)

We ship our units within the 48 continental United States and Canada. We ship all of our units by freight truck. Upon arrival of shipment, all packages must be inspected for damages on site with the Freight Company before the unit is signed for. If the package appears to be damaged, call our technical department immediately for instructions. We can advise whether the visible damages to the crates are detrimental to the units. Once the unit is signed for there is no way we can process the insurance claim with the Freight Company. In the event that the unit arrives damaged and the entire shipment or parts of the shipment is refused, we will replace the unit/parts upon availability of replacement unit or parts that are damaged. Delivery is subject to delays caused by limited product availability or Freight Company problems. The unit must be installed by a licensed plumber and electrician, or it will void the warranty of the unit from the manufacturer. The product purchaser accepts full responsibility and liability for its proper use, operation, and installation. This unit is not to be used for commercial purposes. The purchaser also agrees to hold harmless and indemnify us from any actions, lawsuits, judgments, and liability claims arising from the use of these products.

Upon arrival of your unit, please inspect the exterior and interior for damages. You must open and inspect the parts for any type of damage and report it to the driver IMMEDIATELY. For any damages you see, PLEASE WRITE IT on the Delivery Bill of Lading and YOU MUST HAVE THE DRIVER NOTE THIS WITH HIS OWN SIGNATURE AND WRITING AND YOU NEED TO KEEP YOUR COPY.Immediately contact us for more information. Also, we will need you to fax that copy to 714-622-1559. If the unit is signed without inspection or notation, you are accepting the delivery of the package in perfect condition. There is no way we can process the insurance claim with the Freight Company if signed (which means you received it in perfect condition). We will do everything in our power to help you on a claim if this shall come up. In the event that the unit arrives damaged and the entire shipment or parts of the shipment is refused, we will replace the unit/parts upon availability of replacement unit or parts that are damaged. After writing "damaged" on the bill of lading, you have 72 hours to report the contents that are damaged to us.

Please do not wait as this is very IMPORTANT, otherwise the freight company will not cover the replacement charges and you will be held liable. PLEASE KEEP ALL BOXES AND ORIGINAL PACKAGING. IF THE UNIT IS DAMAGED, THE INSPECTOR WILL NEED TO COME AND INSPECT THE PACKAGE TO SEE HOW DAMAGED IT IS AND WHAT THEY ARE ABLE TO FILE ON THE CLAIM. IF THE BOXES AND PACKAGING ARE MISSING, THE FREIGHT COMPANY WILL SAY THEY ARE NOT LIABLE SINCE IT CAN'T BE PROVEN THAT THEY WERE RESPONSIBLE FOR SUCH DAMAGES WITHOUT SEEING THE CRATE/BOX.

It is important that you inspect your package by opening it. Please open it carefully and keep the box/crate in its original form using a box cutter for cutting tape. If the package is damaged, you may have to put the product back in the original packaging to prevent further damage from occurring during the return shipment back to our warehouse.

PLEASE DO NOT WAIT WEEKS OR MONTHS TO OPEN UP YOUR PACKAGE; PLEASE INSPECT IT IMMEDIATELY, EVEN IF YOU WILL NOT BE INSTALLING THE UNIT. The shipping company requires the customer to report any damages within the first 72 hours after delivery.

If a shipment comes in different boxes and it comes damaged, please only refuse the package that is damaged, and we will ship you out a new part subject to availability. Again, if one crate is damaged, please just refuse the damaged crate back, not the entire unit.

Delivery is subject to delays caused by limited product availability, freight company problems, and/or weather conditions.

In the event a product is listed at an incorrect price due to a display or typographical error, or an error in pricing information received from our suppliers, or store partners, SteamShowersInc.com shall have the right to refuse or cancel any orders placed for product(s) listed at the incorrect price. SteamShowersInc.com shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your Credit Card charged. If your Credit Card has already been charged for the purchase and your order is cancelled, SteamShowersInc.com shall immediately issue a credit to your Credit Card account in the amount of your original charge. If you paid using Check, the refund will be made out to you using a Company Check.

For optimal performance, we recommend Internet Explorer version 7.0 or higher, Mozilla Firefox version 3.5 or higher, and Safari version 4.0 or higher. JavaScript and Cookies should be enabled to complete online transactions. We recommend setting your monitor resolution to 1024 x 768 pixels or higher.

Important Customer Notes

You are advised not to book your plumber or carry out any preparatory work on your bathroom until your goods have arrived and been checked. SteamShowersInc.com cannot accept any liability for losses accruing from plumber or preparatory costs.

Please make sure you check that all items are present and free from any defects upon delivery and before signing the delivery note. You must report any missing or damaged items to Steam Showers Inc within 72 hours of delivery so we can help resolve this situation.

The steam showers, whirlpool bathtubs and sauna units are considered bulky items. Your items will be delivered by a single driver. Therefore, please make sure there is an able bodied person available to help our delivery person unload the items.

Cancellations & Returns

Provided units are brand new and uninstalled, you can return all items purchased from SteamShowersInc.com within 20 days from ship date when it leaves our warehouse.

To qualify, simply initiate the return within 20 days from the ship date and ensure that the item is in its original condition (including: packaging, manuals, accessories, original crate, etc.). We must receive your item back within 30 days of when we originally shipped it to you. Please allow us 3 - 5 days from the time we receive the return to process your refund.

Due to the high risk of damage when shipped back to our location, you must package the product the same way you received it, including any shrink wrap, tape and foam. This will help prevent damages back to us. Damaged packages shipped back to us due to poor packaging may result with a restocking fee of up to 25%.

For your protection, we suggest all returns be sent back by a traceable carrier. The customer must pay all costs related to original shipping and return shipping even if shipping was free. After receiving and inspecting the returned merchandise, we will reimburse your Credit Card for the purchase price of the item, less the original shipping fee, return shipping fee, and less a restocking fee of 15%. A restocking fee of up to 25% will be applied if not returned in good faith (used products, not packaged properly, damaged products, etc).

For refunds on purchases made with a Credit Card, we will issue a credit to the same Credit Card used to make the purchase. If you paid using Check, the refund will be made out to you using a Company Check.

Damaged Products

Upon receiving your item, it is important that you open all packaging and check that items are present and not damaged. Any damage must be reported to SteamShowersInc.com within 72 hours of delivery. Any damage that has been caused by transit of goods must be noted upon the carrier's delivery note. Carriers require that you sign for all items being in good condition upon delivery. It is important that somebody is present to receive and check the items for damage on the day of delivery.

Certification

It is the customers' responsibility to check if these units will comply with their state, county or city codes. If you will be receiving an inspection by a county or city inspector, please ask them what they require. If you do require an inspection, we recommend the Ariel Platinum or AmeriSteam units as they are compliant with ETL (UL) listings. WMK also comply with ETL (UL) marks in most states. If a customer purchases any steam shower unit or bathtub that does not pass inspection, we allow returns with the following conditions below. You will be able to return the unit for purchase price of unit, less the original shipping fee, return shipping fee, and less a restocking fee of 15% if in original packaging. If the shower unit or bathtub was opened, or opened and assembled, a 25% restocking fee will apply.

Canadian Customers

Under The North American Free Trade Agreement (NAFTA), Canadians do not have to pay duty on most American and Mexican manufactured items. We ship from the United States for our products; however, our shower enclosures are manufactured overseas. The customer is responsible for any duties and/or taxes. Back Orders

If your order is not in stock, then a member of our sales team will contact you and give you a revised delivery date. At this point you have the option to withdraw the order if you are unable to wait for the item.

Guarantee

All parts include a 60 month guarantee against defects. In the unlikely event that a defect develops in one of the parts, then please contact our tech department, who will arrange for a spare part to be delivered to you. Please note, SteamShowersInc.com recommends that a trained engineer fit the spare part. SteamShowersInc.com cannot accept any liability regarding the installation of spare parts. Your statutory rights are not affected.

Other

If any part of these Terms and Conditions is found by a competent authority to be invalid, unlawful or unenforceable, then such part will be severed from the remainder of these Terms and Conditions, which will continue to be valid and enforceable.
